Legal Aid is still available in England and Wales to help cover the costs of family mediation for those on low incomes or certain benefits. This funding is provided by the Legal Aid Agency (LAA).
Legal Aid for family mediation is means-tested, meaning your eligibility is based on your financial circumstances. You must pass both an income test and a capital (savings/assets) test.
When you apply for Legal Aid with Rhino Mediation our team will take you through a quick assessment. You will be asked to provide some information that will let us check;
Income Test: Your income, including benefits, is assessed against set limits. If you receive certain benefits, such as Universal Credit, Income-based Jobseeker’s Allowance (JSA), Income-based Employment and Support Allowance (ESA), or Income Support, you are highly likely to be eligible.
Capital Test: Your savings, investments, and valuable assets (like property, excluding your primary residence unless there is a substantial amount of equity) will be checked to ensure they do not exceed the set limits.
Eligibility is determined by two tests:
Receive certain benefits (e.g., Universal Credit, ESA, Income Support), have low income or have limited savings or capital.
You will be asked to provide proof of earnings, rent/mortgage, dependants, debts and priority financial commitments.
